LIBBY’S “TABLE-GATING” RECIPE CONTEST

OFFICIAL RULES

NO PAYMENT OR PURCHASE NECESSARY TO ENTER. PAYMENT WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID OUTSIDE THE 48 CONTIGUOUS UNITED STATES AND WASHINGTON, D.C. AND WHERE RESTRICTED, TAXED OR PROHIBITED BY LAW.

  1. HOW IT WORKS: During the Entry Period (defined below), Libby’s invites you to enter the Libby’s “Table-Gating” Recipe Contest (“Contest”), by submitting an original recipe using a Libby’s product as one of the ingredients.
  2. ELIGIBILITY: Open only to legal residents of the 48 contiguous United States and Washington, D.C., who are 21 years of age or older as of date of entry. Void in Alaska, Hawaii and where prohibited, taxed or restricted by law. Employees, directors and officers of Seneca Foods Corporation, its affiliates, subsidiaries, advertising and promotion agencies and the immediate family members and/or those living in the same household of each are not eligible. Culinary professionals, food writers and critics, cooking teachers, any member of any culinary professional trade association and any person who has served as a chef or assistant chef in a hotel, restaurant, institution, or private catering service (not including quick service restaurants) in the last 5 years are not eligible, in the sole determination of Sponsor. Contest may only be entered in or from the 48 contiguous United States and the District of Columbia, and entries originating from any other jurisdiction are not eligible for entry.
  3. TWO WAYS TO ENTER: You may enter via one of the two methods outlined below. More than one recipe will be accepted per person, but each recipe must be unique and submitted separately (e.g. one entry per Official Entry Form or on-line submission).
    1. ENTER ONLINE: Beginning 12:01 AM Eastern Standard Time (“ET”) on 3/28/09 through 11:59 PM (ET) on 6/30/09 (the “Entry Period”), visit www.GetBacktotheTable.com and follow the on-screen directions to submit your original recipe. Your entry must comply with Recipe Guidelines outlined below. In the event of a dispute, entries made by Internet will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The “authorized account holder” is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.
    2. ENTER AT SELECT SPEEDWAYS: Visit the Libby’s Get Back to the Table Tent at one of (4) select speedway events from approximately 4/3/09 through 6/30/09. Visit www.GetBacktotheTable.com for specific event locations and dates. On an Official Entry Form, hand print the following: a) your complete name, street address (no P.O. Boxes), city, state, zip code, date of birth (mm/dd/yyyy) and day & evening telephone numbers and b) your original recipe. Your entry must comply with the Recipe Guidelines outlined below. Deposit your entry in the receptacle available at the tent prior to close of event.

      No mechanically reproduced entries, alterations, facsimiles, or forged entries permitted. Illegible, incomplete, invalid, unintelligible entries are void. Not responsible for lost, late, stolen, mutilated, technically corrupted, misdirected entries. All entries become the sole and exclusive property of Sponsor and receipt of entries will not be acknowledged or returned.

      RECIPE GUIDELINES: Recipes must include at least one Libby’s product as one of the ingredients and may not include any products which are competitive to Libby’s products, as determined by Sponsor in its sole discretion. Ingredients must be readily available. All ingredients must be listed together with specific measurements/weights. Complete preparation instructions must be given along with timing and approximate number of servings. By entering a recipe, entrant represents and warrants that such recipe is an original recipe, created by entrant that has not previously been published nor won a prize or award. Recipes must be in English. A list of Libby’s products may be found at http://www.senecafoods.com/ourbrands/libbys.shtml.

  4. PRELIMINARY JUDGING: All entries will be preliminarily judged to determine (25) Semi-Finalists, selected as follows: (5) from among each of the (4) speedway events and (5) from among the Online entries. All preliminary judging will be based on the following criteria: originality – 50%, perceived ease of preparation – 30% and creative use of Libby’s ingredient(s) – 20%. In the event a tie needs to be broken, tied entries will be rejudged in accordance with the above criteria.
  5. FINALIST JUDGING: Recipes submitted by (25) Semi-Finalists determined via Rule #4 will be prepared by a panel of food experts and then judged by Sponsor to determine (5) Finalists, selected as follows: (1) will be determined from each of the (4) speedway event Semi-Finalist groups and (1) from the group of Online entry Semi-Finalists. Judging will be based on the following criteria: taste - 50%, ease of preparation– 20%, appearance – 15% and originality and creativity – 15%. In the event a tie needs to be broken, tied entries will be rejudged in accordance with the above criteria. The (5) Finalists will each receive a Finalist Prize, subject to verification of eligibility. Limit one Finalist Prize per family/household.

    Finalists agree and acknowledge that their recipes will be posted on GetBacktotheTable.com.

  6. FINALIST EVENT: The Finalist event will be held in New York City in September, 2009. At the Finalist event, each of the (5) Finalists, determined via Rule #5, will be required to attend and personally prepare their recipes exactly as submitted. Judging to determine the Grand Prize winner will be accomplished by Sara Evans and additional judges. Judging will be based on the criteria set forth in Rule #5 and the highest scoring Finalist will be deemed the Grand Prize Winner, subject to eligibility verification. Sponsor will select and supply ingredients and cooking equipment to be used at the judging event. Sponsor reserves the right to substitute comparable ingredients, equipment and judges at its sole discretion. Finalists must agree to travel on dates specified by Sponsor; event dates and times will be determined by Sponsor, and are subject to change. Sponsor and its agencies reserve the right to disqualify any entry that, in their sole opinion, refers, depicts or in any way reflects negatively upon the Sponsor, the promotion or any other person or entity.
  7. PRIZES & APPROXIMATE RETAIL VALUES: (1) Grand Prize will be awarded to the Grand Prize Winner, which includes a 3-day/2-night rip for 4 to Daytona Beach, FL and $1,000 spending cash. Grand Prize includes round-trip coach air transportation from major airport nearest Grand Prize Winner’s home, hotel accommodations (2 rooms, double-occupancy), and ground transportation between destination airport and hotel (ARV: $5,500). Five (5) Finalist Prizes will be awarded, one (1) to each Finalist, which includes a 2-day/1-night trip for two to New York City to compete in the Finalist event competition in September, 2009, specific dates of travel will be determined by Sponsor. Finalist Prize includes round-trip coach air transportation from major airport nearest Finalist’s home, hotel accommodations (1 room, double-occupancy), and ground transportation between destination airport, hotel and event (ARV: $2,000 per Finalist Prize, total ARV for Finalist Prizes $10,000). Actual trip values may vary depending on point of departure and airfare fluctuations. Finalists who live within a 200-mile radius of the New York City event will receive $200 in lieu of air transportation. In the event the Grand Prize winner lives within a 200-mile radius of Daytona Beach, FL, he/she will receive $200 in lieu of air transportation. All prizes consist of only the items specifically listed as part of the prize.

    If a minor (other than winner’s child or ward) is selected as a traveling companion, he/she must be accompanied by his/her parent/legal guardian who will become one of the 3 traveling companions. All travelers must travel on same itinerary and at the same time as the winner (including both the five (5) Finalists and the Grand Prize Winner, individually, the “winner,” and collectively, the “winners”). Unless otherwise indicated, prizes do not provide spending money; all extras are at winner’s own expense. Travel must be roundtrip. Sponsor will determine flight itinerary and hotel accommodations in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in this Contest, and those set forth by the Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, meals, incidentals, passenger tariffs or duties, surcharges, travel insurance, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. Travel restrictions, conditions and limitations may apply. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Winner will not receive difference between actual and approximate retail value, if any.

  8. GENERAL RULES: Participation constitutes full and unconditional agreement to these Official Rules and Sponsor’s and judges’ decisions, which are final and binding in all matters related to this contest. No substitution or transfer of prize by winner permitted. Sponsor reserves the right to substitute prize of equal or greater value. All federal, state and local taxes are the sole responsibility of winner. All federal, state and local laws apply. Potential Finalists must sign and return an Affidavit of Eligibility/Release of Liability/Publicity Release, within 5 days of notification. Noncompliance within this time period or return of any prize/prize notification as undeliverable will result in disqualification and an alternate will be selected, time permitting. All winners and traveling companions must execute a Release of Liability prior to ticketing and must possess required travel documents (e.g., valid photo ID) prior to departure. Grand Prize Winner must agree to travel on dates specified by Sponsor; event dates and times will be determined by Sponsor, and are subject to change. Sponsor reserves the right in its sole discretion to disqualify any entry which does not comply with these Official Rules. Sponsor reserves the right to: (a) use entrant’s name and likeness and publish all entries submitted, (b) alter, amend, edit or change entries prior to publication and (c) use, publish, reproduce, alter, amend and copyright for purposes of advertising and trade without further compensation, unless prohibited by law. By accepting prize, each winner agrees to hold Sponsor, their respective directors, officers, employees and assigns, harmless against any and all claims and liability arising out of use of the applicable prize. Entrants agree to release, discharge and hold harmless Seneca Foods Corporation, their respective subsidiaries, affiliates, officers, directors, shareholders, employees, agents, attorneys, other representatives, advertising, promotion and fulfillment agencies, harmless from and against any and all liability and damages relating to this Contest and their participation thereto. Winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use or redemption of any prize. Sponsor, affiliates, subsidiaries and agencies are not responsible for any typographical or other error in the printing, the offering or announcement of any prize or in the administration of the promotion. In the event there is a discrepancy between these Official Rules and any Contest materials, the Official Rules shall prevail, govern and control.

    INTERNET CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

    Sponsor, affiliates, subsidiaries and agencies are not responsible for faulty, incorrect or mistranscribed phone transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person's computer related to or resulting from participating in or experiencing any materials in connection with the Contest, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user's ability to participate in the Contest. If for any reason the Contest is not capable of running as planned, including without limitation, due to fraud, misconduct or technical failures destroy the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration or security of the program as determined by Sponsor/judging agency/administrator, in their sole discretion, Sponsor reserves the right to cancel or modify the Contest. In the event the online entry portion of the Contest is terminated, a notice will be posted online and all eligible entries received prior to termination will be included in the preliminary judging indicated in Rule #3A. Proof of submitting entries will not be deemed to be proof of receipt by Sponsor. Any use of robotic, automatic, programmed or the like methods of participation will void all such entries by such methods. Sponsor reserves the right to prohibit the participation of an individual if fraud, hacking, cheating or tampering is suspected or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.

  9. Privacy: Sponsor will be collecting personal data about entrants in accordance with its privacy policy. Please review Sponsor's privacy policy for this Contest at www.GetBacktotheTable.com. By participating in the Contest, you hereby agree to Sponsor's collection and usage of your personal information, and acknowledge that you have read and agreed to the Contest's privacy policy.
  10. Winners List: The names of the Grand Prize Winner and Finalist Prize Winners will be posted on www.GetBacktotheTable.com beginning September, 2009 for a minimum of 2 weeks.
